Terms of Service

These Terms of Service ("Terms") govern your access to and use of mydivelocker.com and related applications (the "Service"), operated by Threshold Operations ("My Dive Locker," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of Service
My Dive Locker is a diving certification and compliance management platform. It allows divers to log dives, store certification records, track equipment, manage medical waivers and insurance information, generate Apple Wallet/Google Wallet passes, and share verified compliance status with dive operators. It allows dive operators to manage manifests and verify diver compliance.
2. Eligibility and Accounts
You must be at least 13 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.
3. Subscriptions, Renewal, and Refunds
Certain features require a paid membership, billed on an annual basis. By subscribing, you authorize us to charge your payment method on file for the applicable fee, including future renewals.
Automatic Renewal. Your membership will automatically renew at the end of each annual term unless you cancel prior to the renewal date. We will provide notice of the upcoming renewal charge in accordance with applicable law. You may cancel automatic renewal at any time through your account settings or by contacting us; cancellation takes effect at the end of your current membership term, and you will retain access through that date with no further charges.
Refunds. All membership fees, including renewal charges, are non-refundable after three (3) days from the date of the charge. Requests made within three (3) days of the original charge or any renewal charge will be honored in full. No refunds will be issued for requests made after this three (3) day window, including in cases of partial use, non-use, or early cancellation of the membership term.
4. Diving Is Inherently Dangerous — Assumption of Risk
Scuba diving is an activity that carries inherent risks, including serious injury and death. My Dive Locker is a record-keeping and compliance-communication tool. It is not a substitute for proper training, dive planning, medical clearance, buddy checks, or professional judgment.
By using the Service, you acknowledge and agree that:
- You are solely responsible for your own dive planning, risk assessment, and decisions regarding whether you are medically and physically fit to dive.
- Certification records, medical waiver statuses, and compliance indicators displayed in the Service reflect information you or a linked source entered, and My Dive Locker does not independently verify your fitness to dive, the accuracy of imported dive computer data, or the adequacy of any dive plan generated or assisted by the Service.
- The AI Concierge feature provides general informational responses only and is not a substitute for professional dive training, medical advice, or the judgment of a certified dive professional. Do not rely on the AI Concierge for real-time dive safety decisions.
- Dive plan calculations (no-decompression limits, gas consumption estimates, and similar figures) are provided for planning reference only. You are responsible for independently verifying all dive planning data against your own dive computer, dive tables, and training before every dive.
- Decompression calculators and algorithm comparisons. This calculator does not warrant that it accurately reflects the Bühlmann ZHL-16C, VPM-B, RGBM, or DSAT/RDP algorithms it implements, or that it won't get you bent or dead, or that it will produce safe, reliable results. These decompression schedules are experimental — use at your own risk. This tool is intended for experienced, appropriately certified divers only. It is not a substitute for dive computer redundancy, formal decompression training, or a physician's medical clearance to dive. Always carry a backup means of computing your decompression obligation.
- Verification features (buddy/instructor confirmation, operator manifest sharing) facilitate communication between you and third parties but do not constitute a guarantee of accuracy by My Dive Locker.
- You assume full responsibility for your own safety and the safety of your diving activities. My Dive Locker, Threshold Operations, and their officers, employees, and affiliates are not liable for any injury, death, or damage arising from or related to your diving activities, regardless of whether you used information from the Service.
5. Dive Operator Use
If you use the Service as a dive operator, you are solely responsible for independently confirming a diver's fitness, certification validity, and compliance status through your own standard operating procedures before permitting them to dive. Compliance indicators shown in My Dive Locker are informational aids and do not replace your professional verification obligations.
6. User Content
You retain ownership of content you upload (photos, videos, notes, dive logs). By uploading content, you grant My Dive Locker a limited license to store, display, and process that content solely to provide the Service to you. You represent that you have the right to upload any content you submit and that it does not infringe on any third party's rights.
7. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose
- Falsify certification records or medical information
- Attempt to access another user's account or data without authorization
- Interfere with or disrupt the Service's infrastructure, including edge functions, APIs, or storage systems
- Reverse-engineer, scrape, or extract data from the Service except as permitted by our API terms, if any
- Use the Send-to-Shop or manifest sharing features to transmit false compliance information
8. Third-Party Services
The Service integrates with third-party providers (Stripe, Supabase, Resend, OpenAI, Mapbox, Apple, Google, and dive computer manufacturers such as Shearwater, Suunto, and Garmin for data import). We are not responsible for the acts, omissions, or availability of these third parties.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA (INCLUDING DIVE PLANS, COMPLIANCE STATUS, OR IMPORTED DIVE COMPUTER DATA) WILL BE ACCURATE OR COMPLETE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY DIVE LOCKER AND THRESHOLD OPERATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, OR ANY PERSONAL INJURY OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR YOUR DIVING ACTIVITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless My Dive Locker, Threshold Operations, and their officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your diving activities, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms, non-payment, or conduct that we determine, in our sole discretion, is harmful to the Service or other users. You may terminate your account at any time by contacting us.
13. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Montgomery County, Tennessee.
14. Changes to These Terms
We may modify these Terms at any time. We will post the updated Terms with a revised effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
